Live Sessions and Recording Policy

1Scope and agreement

This Policy applies to live rooms, audio and video sessions, streams, stages, webinars, calls, and podcast recording features (each a “Session”), and to the resulting recordings, clips, transcripts, and derivative content. The member who creates and controls a Session is the “Host.” Anyone else who joins is a “Participant,” and a Participant invited to appear is a “Guest.” This Policy supplements the Terms of Service, the Community Guidelines, the Acceptable Use Policy, and the Network Privacy and Safety Notice.

2Sessions may be recorded

Sessions may be recorded, streamed, transcribed, captioned, clipped, and published. A recording may capture audio, video, shared screens, shared files, chat, questions, reactions, participant names and images, and participation metadata such as join and leave times. Where a Session is being recorded, the Services indicate it in the interface and, where the feature provides it, announce it at the start.

Assume any Session may be recorded. Even where the Host has not enabled recording, a Participant may capture a Session with tools outside our control. Do not disclose anything in a Session — confidential information, personal data, credentials, client material, or health or financial details — that you would not accept being recorded, transcribed, and shared.

3Consent at join

Where recording is enabled, the Services present a notice before or at the moment of joining. By joining, or by remaining in a Session after a recording notice is shown, you consent to being recorded and to the Host’s use of the recording as described at that point. If you do not consent, do not join, or leave the Session. Where recording begins mid-Session, the Services indicate the change; if you do not consent, leave.

Consent given at join covers the recording itself and its use as described. It does not authorize a use that was not disclosed, and it does not waive a right that law makes non-waivable. You may ask a Host to stop recording, to remove you from a recording, or not to publish a segment in which you appear; the Host decides, subject to the takedown path below and to law.

4Host responsibilities and guest releases

The Host controls the Session and is responsible for it. A Host must: state before recording begins that the Session is being recorded and what the recording will be used for; obtain the consent of every Participant and Guest, and any consent applicable law requires; obtain a release from any Guest whose appearance will be published, edited, clipped, promoted, or distributed; not record a private conversation, a break-out, or a segment a Guest reasonably believes is off the record; honor a Guest’s reasonable request to remove a segment before publication; secure the recording and limit access to it; and comply with any commitment the Host made about confidentiality, embargo, or non-publication.

A Host that publishes a Guest must have obtained, at minimum, that Guest’s permission to record, to publish, and to use the Guest’s name, voice, image, likeness, title, and organization in the recording and in promotion of it. Where the Host operates on behalf of an organization, the organization is responsible alongside the Host. FocalShift AI does not obtain releases for a Host, does not verify that a Host has obtained them, and is not the publisher of the Host’s recording.

5Consent required by local law

Recording law varies. In some jurisdictions every party to a conversation must consent before it may be recorded, and recording without that consent is a criminal offence as well as a civil wrong. Determining and satisfying the requirements that apply to a Session — including where each Participant is located — is the Host’s responsibility. Where any Participant may be in an all-party-consent jurisdiction, obtain express consent from everyone before recording, and record that you did.

The Host is also responsible for restrictions arising from the subject matter — for example recordings involving health information, legal or professional privilege, employment investigations, minors, regulated financial advice, courtrooms, workplaces, schools, or medical settings — and for any notice, consent, or authorization those settings require. FocalShift AI provides a recording feature; it does not advise on and does not assume responsibility for a Host’s compliance.

6Name, image, voice, and likeness

By appearing in a Session that is recorded, you grant the Host a non-exclusive, worldwide, royalty-free licence to record, reproduce, edit, clip, caption, transcribe, translate, publish, distribute, and promote your contribution together with your name, voice, image, likeness, title, and organization as identified in the Session, in the recording and in reasonable promotion of it, in the formats and channels the Host disclosed. You also grant FocalShift AI the licence described in the next section, to the extent needed to operate the Services.

This licence does not permit a use that misrepresents what you said, presents you as endorsing a product or position you did not endorse, places you in a false light, or uses your likeness to create synthetic audio or video of you saying something you did not say. Cloning a Participant’s voice or likeness from a Session requires that person’s separate express written permission.

7Distribution and the platform licence

You grant FocalShift AI a worldwide, non-exclusive, royalty-free licence to host, store, encode, transmit, cache, transcribe, caption, index, moderate, and display Session content and recordings as needed to operate, secure, support, and improve the Services, and to distribute them to the audiences the Host and the participants’ settings select. This licence is limited to operating the Services; it does not permit FocalShift AI to publish your Session as its own marketing without your separate permission.

Where a recording is published to a public surface, it may be visible to anyone, appear in search and recommendations, be indexed by external search engines, and be copied or re-shared by others. Removing a recording from FocalShift AI does not remove copies others have made.

8Minors

Sessions are for adults. A person under 18 may not host, appear in, be a Guest on, or be a subject of a Session, stream, or recording made through the Services, and a Host must not knowingly include one. Do not record or publish a child, and do not use a Session to solicit, contact, or feature a minor. Where we learn that a minor appears in a Session or recording, we may remove the recording, restrict the Session, and act under the Age Eligibility and Children’s Privacy Notice and the Account Suspension and Termination Policy. Report a Session involving a minor immediately through in-product reporting or FocalShift Contact.

9Live moderation

Community Guidelines and the Acceptable Use Policy apply in real time. A Host is responsible for moderating its own Session and may mute, remove, and block Participants and disable chat. FocalShift AI may, during or after a Session and with or without notice: display a warning or label; limit or disable chat, screen share, or streaming; remove a Participant; interrupt or end a Session; prevent a Session from starting; restrict a Host’s live features; and remove or restrict a recording. Grounds include credible threats, harassment, sexual content, exploitation of minors, self-harm promotion, violent or graphic material, illegal activity, infringement, deceptive impersonation or synthetic media, coordinated abuse, and security risk.

Live moderation is necessarily partial and may rely on automated signals, reports, and sampling; we do not monitor every Session, and no review or failure to act is an approval. Enforcement and appeal follow the Content Moderation, Reporting, and Appeals Policy.

10Takedown and removal

If you appear in a recording that was made or published without your consent, that exceeds the use disclosed to you, or that misuses your name or likeness, ask the Host first where it is safe and practical to do so, then submit a request through FocalShift Contact identifying the recording by title and link, the segment and timestamp, and the basis for removal. We may restrict access to a recording while we review, and may remove it, remove a segment, or require the Host to remove it. Copyright complaints follow the Copyright and DMCA Policy; safety reports are handled under the moderation policy and may be escalated to authorities where required.

A Host must comply with a removal request that law requires it to honor, and must not republish material we have removed. A Host that repeatedly publishes without consent may lose access to live and recording features.

11Retention and access

Recordings, transcripts, chat logs, and participation records are retained under the settings of the Host or the Host’s organization and the retention rules in the Datenschutzrichtlinie. A Host may delete a recording; deletion removes it from the Services within a reasonable period, after which residual copies may persist in routine backups for a limited period and are then overwritten. We may retain a recording longer where required for a legal obligation, a legal hold, a dispute, a safety investigation, or an ongoing enforcement matter. Where an organization holds the account, its administrators may access recordings made in its workspace, as described in the Teams and Organizations Addendum.

12Changes and contact

We may update this Policy as live and recording features, safety practices, and legal requirements change, with notice where required. Questions, consent concerns, and recording reports may be submitted through FocalShift Contact.
