Hosting and Infrastructure Addendum

This Addendum governs managed hosting, servers, websites, and related infrastructure services provided through FocalShift AI.

1Scope and agreement

This Addendum applies to managed hosting, provisioned servers, hosted websites and applications, databases, storage, domains and certificates issued through the Services, and related infrastructure (together, the “Hosting Services”). It supplements the Terms of Service and controls over them on the subjects covered here. Ordering or using a Hosting Service means you accept this Addendum.

You are the operator of anything you host. FocalShift AI provides and manages infrastructure; it does not author, review, approve, or take responsibility for your site, its code, its content, its plugins or extensions, or its business.

2Availability — no uptime guarantee

The Hosting Services are provided on an as-is and as-available basis. FocalShift AI does not guarantee uptime, availability, latency, throughput, or continuous operation, and offers no service-level agreement, uptime commitment, or availability credit unless one is set out in a written agreement signed by FocalShift AI. Any availability figure, monitoring display, or performance description in marketing, dashboards, or documentation is descriptive and is not a warranty or a commitment.

Interruptions may arise from planned and emergency maintenance, upgrades, migrations, security response, capacity constraints, configuration changes you or your developers make, your own code, plugins, themes, or integrations, attacks and abuse, upstream provider incidents, network events, domain or certificate issues outside our control, and force majeure. We will use commercially reasonable efforts to restore service and, where practicable, to give advance notice of planned maintenance likely to be disruptive.

3Backups are best-effort — you must keep your own

Where a backup feature is included, FocalShift AI takes automated backups on the schedule and retention shown in the hosting interface, on a commercially reasonable, best-effort basis. Backups are a convenience, not a guarantee. We do not warrant that a backup will exist, will be complete, will be uncorrupted, will include every file, database, configuration, or media item, will cover data written since the last successful run, or will restore successfully. Backup and restore capability may change with the plan and the product.

You are responsible for maintaining your own independent backups of anything you cannot afford to lose, stored outside FocalShift AI, and for verifying periodically that you can restore from them. You are also responsible for testing restores of any material you rely on, and for keeping your own copies of code, credentials, and configuration. A restore we perform overwrites current data with the state at the restore point and may discard everything written since; you are responsible for choosing the restore point and for the consequences of the restore.

4Data loss and limitation

To the maximum extent permitted by law, FocalShift AI is not liable for loss, corruption, deletion, or unavailability of hosted data, sites, databases, media, email, or configuration, or for lost profits, revenue, goodwill, or business opportunity arising from a hosting incident. FocalShift AI’s aggregate liability for a claim relating to an affected hosted service will not exceed the fees you paid for that service during the three months before the event, as provided in the limitation-of-liability section of the Terms of Service, and the carve-outs stated there apply here as well. This section allocates risk in exchange for the price of the service; the price would be materially higher without it.

5Content on hosted sites

Everything you host must comply with the Acceptable Use Policy, the Prohibited and Restricted Businesses Policy, and applicable law, and you must hold the rights to it. You are the publisher: you are responsible for your site’s content, claims, disclosures, consumer terms, cookie and privacy notices, accessibility, age gating, and licensing, and for the content your own users submit to it.

Copyright complaints about hosted material follow the Copyright and DMCA Policy, including the member-hosted-website path described there. Depending on the notice and the risk, we may remove or disable a specific item, disable a directory or route, suspend a site, or suspend the hosting account for repeat infringement, and we will notify you where legally permitted. We do not monitor hosted content, and no review, scan, or failure to act is an approval of what you host.

6Resource use, abuse, and suspension

Each plan includes the resources shown at purchase — such as storage, bandwidth or transfer, compute, memory, processes, database size, email volume, and site count. Sustained use beyond those levels, or use that degrades the environment for others, may result in throttling, a request to upgrade, an overage charge where disclosed, or restriction. You may not use the Hosting Services for cryptocurrency mining, distributed computing not related to your own site, open proxies or relays, bulk unsolicited mail, torrent or bulk file distribution unrelated to your business, load testing without our written agreement, or resale of raw infrastructure unless your plan expressly permits it.

We may suspend a site, a service, or an account immediately and without advance notice where necessary to protect the platform or third parties — including malware, defacement, a compromised or unpatched application, an active attack originating from or targeting the environment, spam or blocklisting, credential compromise, resource abuse, illegal content, or non-payment. Where we suspend, we will notify you and describe what is required to restore service; you are responsible for remediating the underlying cause. We may quarantine or remove malicious files as part of protecting the environment.

7Software, updates, and your responsibility for what you install

We manage the underlying operating system, web server, runtime, and platform components, and may apply security patches, version upgrades, and configuration changes — sometimes urgently and without advance notice — to keep the environment secure and supported. A required upgrade may affect compatibility with your application, theme, plugin, extension, or custom code.

You are responsible for your application and everything you install in it, including keeping it updated, testing changes, maintaining compatibility, licensing what you install, and the security consequences of what you add. We may disable or remove software that is insecure, abusive, unlicensed, or incompatible with the platform. Where a staging or test environment is available, use it before applying changes to a production site.

8Migration, export, and end of service

You may export or migrate your hosted data at any time using available tools, and we will provide reasonable assistance to obtain a copy of your site files and databases while your account is active and in good standing. Any migration service we perform is a best-effort service; we do not guarantee a like-for-like result, and you must verify a migrated site before pointing traffic at it.

End of service. If you cancel a Hosting Service, or if we discontinue one, hosted data is retained for a limited wind-down window shown in the hosting interface — ordinarily thirty days after the service ends — during which you may export it, after which it is deleted and is not recoverable. Where we discontinue a service, we will give reasonable advance notice and a reasonable export period. Where an account is terminated for cause, we may shorten or decline a wind-down window, subject to law. Following deletion, residual copies may persist in routine backups for a limited period and are then overwritten. Domains and certificates you hold through us follow their own registrar or issuer rules and expiry.

9Third-party infrastructure

The Hosting Services run on third-party infrastructure, including cloud infrastructure provided by DigitalOcean, LLC, and may use third-party networks, content-delivery, certificate, registrar, security, and email providers. Your use is subject to those providers’ terms, acceptable-use rules, regional availability, and maintenance windows, and those terms pass through to you to the extent they apply. A provider’s outage, policy decision, price change, regional change, service discontinuation, or enforcement action may affect your service, and FocalShift AI is not responsible for it beyond making commercially reasonable efforts to restore or relocate service. Named infrastructure providers appear in the subprocessor table in the Data Processing Addendum.

10Support scope

Support covers the infrastructure we manage: provisioning, platform configuration, platform-level performance and security, backups and restores where included, domains and certificates issued through us, and diagnosing whether an issue is platform-side. Support does not include developing, debugging, or optimizing your application, theme, plugin, or custom code; content or design work; third-party licence issues; or recovering data you did not back up, beyond what our own backups can provide. Where a paid customization or development service is available, it is provided under its own scope and terms. Response timing follows the Support and Contact Policy.

11Changes and contact

We may update this Addendum, plan resources, and platform configuration as the Hosting Services, security requirements, provider terms, and legal requirements change, with notice where required and reasonable notice before a change that materially reduces an included resource. Hosting questions, incident reports, and abuse reports may be submitted through FocalShift Contact.
