California Privacy Notice

This Notice supplements the Privacy Policy for California residents and describes personal-information practices and rights under applicable California privacy law.

1Categories collected

Depending on how a person interacts with FocalShift, we may collect identifiers; customer-record information; commercial information; internet or electronic-network activity; approximate geolocation; audio, visual, or similar content; professional or employment information; education information; inferences; and account credentials or other information treated as sensitive under California law.

3Purposes

We use personal information to provide accounts and Services; authenticate and secure access; operate workspaces, communications, AI features, publishing, transactions, and integrations; support customers; improve performance; prevent fraud and abuse; comply with law; and communicate about relevant services.

4Disclosure

We may disclose categories of personal information to service providers and contractors; connected services selected by the user; authorized workspace members; payment and transaction providers; professional advisers; parties to a business transaction; and governmental or other parties when required by law or necessary to protect rights and safety.

5Sale, sharing, and targeted advertising

FocalShift does not sell personal information for money. If any advertising or analytics activity constitutes “selling” or “sharing” under California law, eligible residents may opt out through the choice mechanism presented with that activity or by contacting us. We do not knowingly sell or share personal information of people under 16.

6Retention

We retain each category for the period reasonably necessary for the purpose collected, considering account duration, service needs, sensitivity, security, backup cycles, fraud prevention, legal and accounting duties, dispute resolution, and contractual commitments.

7California rights

Subject to exceptions, California residents may request to know categories and specific pieces of personal information; correct inaccurate information; delete information; obtain information about collection, use, and disclosure; opt out of sale or sharing; limit certain use of sensitive personal information; and receive equal service and pricing without unlawful discrimination.

8Sensitive personal information

Some information we process may be treated as sensitive personal information under California law — for example account log-in credentials in combination with an access code or password, precise geolocation where a member supplies it, government identifiers and tax identification numbers collected for payout, identity, or sanctions verification, financial-account information used for payouts, and the contents of member messages where FocalShift is not the intended recipient. We use and disclose this information only to perform the Services, process transactions, provide security and fraud prevention, verify identity, meet legal and tax obligations, maintain quality and safety, and for other purposes California law permits without a right to limit. We do not use or disclose sensitive personal information to infer characteristics about a person, and we do not sell it or share it for cross-context behavioral advertising. Because our use is limited to permitted purposes, the right to limit use of sensitive personal information does not apply; if that changes, we will publish a limitation method here.

9Financial incentives

FocalShift operates a referral and affiliate program under which participants may receive commissions for referred subscriptions, and may from time to time offer promotional credits, discounts, or extended trials in exchange for participation in a program that involves personal information. To the extent any of these constitutes a financial incentive or price or service difference under California law: participation is voluntary and requires opt-in through the applicable enrollment flow; a participant may withdraw at any time by closing the program account or contacting us, which ends future accrual but does not reverse commissions already earned and paid; the material terms of each program — including current commission rate, qualifying actions, attribution window, hold period, and minimum payout — are presented in the partner account and in the Affiliate Program Agreement. We offer these programs to acquire and retain customers, and we have made a good-faith estimate that the value of the personal information involved is reasonably related to the value of the incentive, calculated by reference to the expected margin on a referred subscription net of program cost. Nothing in a program conditions your privacy rights on participation.

10Disclosures in the preceding twelve months

In the preceding twelve months, we collected the categories of personal information described under “Categories collected,” from the sources described under “Sources,” for the purposes described under “Purposes,” and disclosed each of those categories for a business purpose to the recipient types described under “Disclosure” — service providers and contractors, connected services the user selected, authorized workspace members and organization administrators, payment and transaction providers, and government or legal recipients where required. Named service providers appear in the subprocessor table in the Data Processing Addendum. We did not sell personal information for money and did not knowingly sell or share the personal information of consumers under sixteen. This mapping is refreshed when this Notice is updated.

11Requests and verification

Submit a request through FocalShift Contact. We may request information reasonably necessary to verify identity and authority. An authorized agent must provide proof of authorization, and we may confirm the request directly with the resident. If we deny a request, we will explain the basis when required.

12Notice at collection

At or before collection, we provide notice of relevant categories and purposes through this Notice, the سياسة الخصوصية, product interfaces, forms, and contextual notices. We do not collect additional categories or use information for materially incompatible purposes without required notice.
